Custom Artwork Information and Terms and Conditions 2024

A request does not confirm a custom is ordered and or guaranteed it going to be created.
Emily Wesley-Jones (Emily) has the right to decline or discontinue work where she sees fit and with in reason.
A initial deposit of 50% of the final price is required for the piece to be created this is due with in 5 working days to secure your spot. Payment after this time period may result in a delayed time turn over or you may miss out completely as if deposit is not paid within the time period of 5 working days you are forgoing the holding of your custom spot and are at risk of it being passed on to a waitlist client. – You will receive a quote with a final price prior to the commission piece being started. Commission will not be started until initial deposit is received and time period begins from the date and time of the deposit being received. This deposit is non-refundable. If you do not wish to proceed or are unhappy to continue working with me this deposit is strictly non-refundable and by paying you acknowledge and agree you will not get this deposit back under any circumstance. Once your piece is created you will be contacted with a draft copy that you can check over at which point adjustments can be made if needed and desired before the piece is finalised and confirmed. Up to 5 drafts are included with no extra charge.
Once your piece is finalised the remaining amount of the total needs to be paid before the item is emailed/shipped or picked up.
Each piece is custom so please allow 2-3 weeks for completion of your piece. This time frame is a guide but may vary either way in length please let us know if you require your custom by a certain date.
Sharing your custom: Emily owns full rights to share all customs on Emmys Creative social media, marketing, and for other uses where I see fit. If you do not wish for your piece to be shared please tell me and I will respect your wishes and not share the creation. I will not share customs until after Christmas or the gifting date ( if provided ) and have a delayed sharing time minimum of 1 month after you receive your print. Being able to share customs means I can show my work to other potential customers and thus, be able to create more custom work for people to cherish and love.
You will be emailed another copy of the terms and conditions at the start of contact, please also read this in case there are specific T&Cs tailored to individual customs.
Terms and Conditions for Graphic Design Services
1. Scope of Work
The scope of work, including deliverables, timeline, and project specifics, will be detailed in the project proposal or agreement. Any additional requests outside the agreed scope will require a separate agreement and may incur additional charges.
2. Payment Terms
2.1 Deposit: A 50% non-refundable deposit is required before the project commences. This deposit secures your project in the designer’s schedule.
2.2 Final Payment: The remaining 50% is due upon project completion, prior to the release of final files.
3. Cancellation Policy
If the client chooses to cancel the project after work has commenced, the initial deposit will not be refunded. Any work completed beyond the value of the deposit will be billed to the client at the agreed hourly/project rate.
4. Revisions
The projects includes 3 rounds of revisions. Additional revisions will be billed at an hourly rate of $20nzd unless otherwise agreed.
5. Ownership and Copyright
5.1 The designer retains copyright of all work created until full payment has been received.
5.2 Upon full payment, the client receives a license to use the final designs for agreed purposes.
6. Liability
The designer is not responsible for any issues arising from the misuse of final deliverables. It is the client’s responsibility to proofread and approve all work before production or publication.
7. Deadlines and Delays
Both parties agree to adhere to the project timeline. Delays caused by the client (e.g., delayed feedback, incomplete materials) may result in an adjusted deadline or additional fees.
8. Confidentiality
Both parties agree to keep any confidential information shared during the project private and not disclose it to third parties.
9. Portfolio Use
The designer reserves the right to showcase the completed project in their portfolio and marketing materials unless otherwise agreed in writing.
10. Governing Law
These terms are governed by the laws of New Zealand, and any disputes will be subject to the jurisdiction of its courts.
